Terms of Service

Welcome to MapleRetreatHotels. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, the "Services"), as well as your stays at our properties.

By accessing or using our Services, or by making a reservation at any of our properties, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services or make reservations with us.

2. Definitions

Throughout these Terms, the following definitions apply:

  • "We," "us," "our," and "MapleRetreatHotels" refer to MapleRetreat Hotels Ltd. and its subsidiaries and affiliates.
  • "You" and "your" refer to the individual or entity accessing or using our Services or staying at our properties.
  • "Services" refers to our website, mobile applications, reservation system, and all related services.
  • "Properties" refers to all hotels, resorts, and accommodations operated under the MapleRetreatHotels brand.
  • "Reservation" refers to a booking for accommodations or services at our properties.

3. Use of Our Services

3.1 Eligibility

You must be at least 18 years old to use our Services or make reservations. By using our Services, you represent and warrant that you meet this requirement.

3.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes.

3.3 Prohibited Uses

You agree not to:

  • Use our Services in any way that violates any applicable law or regulation
  • Use our Services for any unauthorized or illegal purpose
  • Attempt to gain unauthorized access to any portion of our Services or any related systems
  • Interfere with or disrupt the integrity or performance of our Services
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of our Services without express permission
  • Use any robot, spider, or other automatic device to access or monitor our Services
  • Transmit any viruses, malware, or other harmful code
  • Collect or store personal data about other users without their consent

4. Reservations and Cancellations

4.1 Making Reservations

Reservations can be made through our website, mobile app, by phone, email, or through authorized third-party booking platforms. By making a reservation, you warrant that you are at least 18 years old and have the legal authority to enter into this agreement.

4.2 Reservation Confirmation

A reservation is confirmed only after you receive a confirmation number or email from us. We reserve the right to decline any reservation at our discretion.

4.3 Rates and Charges

All rates are quoted in Canadian Dollars unless otherwise specified. Rates may be subject to:

  • Applicable taxes and fees
  • Resort or destination fees
  • Service charges
  • Incidental charges for additional services

Rates may vary based on dates, availability, promotions, and other factors. Rate details will be provided at the time of booking.

4.4 Payment

We accept major credit cards, debit cards, and other payment methods as specified at the time of booking. Depending on the reservation type, payment may be required:

  • At the time of booking (prepaid rate)
  • At check-in or check-out (pay at property rate)
  • According to specific package or promotion terms

A valid credit card may be required to guarantee your reservation, even for pay-at-property rates.

4.5 Cancellations and Modifications

Cancellation and modification policies vary by property, rate type, dates of stay, and length of stay. Specific policies will be provided at the time of booking and in your confirmation.

General cancellation terms:

  • Most standard rate reservations can be cancelled without penalty up to 24-48 hours before check-in
  • Special rates, promotions, or packages may have more restrictive cancellation policies
  • No-shows or late cancellations may result in a charge of one night's stay or more

To cancel or modify a reservation, use our website, mobile app, or contact our reservation team directly.

4.6 Group Bookings

Reservations for ten or more rooms at the same property for similar dates are considered group bookings and are subject to separate terms and conditions.

5. Stay Policies

5.1 Check-in and Check-out

Standard check-in time is 3:00 PM, and check-out time is 12:00 PM local time, unless otherwise specified. Early check-in and late check-out may be available for an additional fee, subject to availability.

5.2 Identification Requirement

You must present a valid government-issued photo identification at check-in. For international guests, a passport may be required. We reserve the right to make a copy of your identification for our records.

5.3 Age Requirement

The guest making the reservation and checking in must be at least 18 years old. Some properties may have higher age requirements, which will be specified at the time of booking.

5.4 Maximum Occupancy

Each room type has a maximum occupancy limit, which will be specified at the time of booking. Exceeding this limit may result in additional charges or the requirement to book additional rooms.

5.5 Damage to Property

You are responsible for any damage to the property, room, or its contents caused by you or your guests during your stay. We reserve the right to charge your credit card for any repairs, replacements, or extraordinary cleaning required.

5.6 Pet Policy

Pet policies vary by property. Some properties are pet-friendly and may allow pets for an additional fee. Service animals are permitted at all properties in accordance with applicable laws.

5.7 Smoking Policy

All MapleRetreatHotels properties are smoke-free environments. Smoking is prohibited in all indoor areas, including guest rooms, restaurants, and public spaces. Designated outdoor smoking areas may be available. Violation of this policy may result in additional cleaning fees.

5.8 Quiet Hours

To ensure a peaceful environment for all guests, quiet hours are generally observed from 10:00 PM to 8:00 AM. We reserve the right to address any noise complaints and may charge a fee or require guests to leave if they repeatedly disturb other guests.

6. Website and Mobile Application

6.1 Intellectual Property

All content on our website and mobile applications, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of MapleRetreatHotels or its content suppliers and is protected by Canadian and international copyright laws.

6.2 Accuracy of Information

We strive to provide accurate and up-to-date information on our website and mobile applications. However, we do not warrant that the information is complete, accurate, or current. We reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice.

6.3 User-Generated Content

If you submit reviews, comments, suggestions, or other content to our website or mobile applications, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that the content you submit:

  • Is your own original content or you have the right to submit it
  • Does not infringe on any third party's intellectual property rights
  • Does not violate any law or regulation
  • Is not defamatory, obscene, threatening, or otherwise harmful

We reserve the right to remove any content that violates these Terms or that we otherwise find objectionable.

6.4 Third-Party Links

Our website and mobile applications may contain links to third-party websites or services that are not owned or controlled by MapleRetreatHotels. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, available at Privacy Policy, explains how we collect, use, disclose, and safeguard your personal information when you use our Services or stay at our properties.

By using our Services or staying at our properties, you agree to the collection, use, and disclosure of your information as described in our Privacy Policy.

8. Loyalty Program

Our MapleRetreat Rewards program is subject to separate terms and conditions, which are available on our website or upon request. Participation in the program is subject to those terms and conditions, as well as these Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MapleRetreatHotels and its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with:

  • Your use of or inability to use our Services
  • Your stay at our properties
  • Any actions or content of third parties

In no event shall our total liability to you for all claims exceed the amount you paid to us for your reservation or, if you have not made a reservation, CAD $100.

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless MapleRetreatHotels and its officers, directors, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

  • Your use of or access to our Services
  • Your stay at our properties
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your conduct in connection with our Services or properties

11. Disclaimers

Our services and properties are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • Our Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from the use of our Services will be accurate or reliable
  • The quality of any products, services, information, or other material purchased or obtained through our Services will meet your expectations

12. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, acts of terrorism, civil unrest, labor disputes, power failures, and internet or telecommunications failures.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law.

13.2 Informal Resolution

Before filing a claim against MapleRetreatHotels, you agree to try to resolve the dispute informally by contacting us at legal@mapleretreathotels.com. We'll try to resolve the dispute informally by contacting you via email. If the dispute is not resolved within 30 days after contact, you or MapleRetreatHotels may bring a formal proceeding.

13.3 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, shall be settled by arbitration in accordance with the ADR Institute of Canada Rules by one arbitrator appointed in accordance with said rules. The place of arbitration shall be Toronto, Ontario. The language of the arbitration shall be English.

13.4 Class Action Waiver

You and MapleRetreatHotels agree that any proceedings to resolve disputes shall be brought on an individual basis only and not in a class, consolidated, or representative action.

13.5 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, or applicable laws. When we make changes, we will update the "Last Updated" date at the top of these Terms. We encourage you to review these Terms periodically.

Your continued use of our Services after the updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, please stop using our Services.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that most closely matches the intent of the original provision.

16. No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of MapleRetreatHotels.

17. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific services or properties, constitute the entire agreement between you and MapleRetreatHotels regarding your use of our Services and stays at our properties.
